1. Status
TravelAR Groep BV, Veemweg 29-31, NL 3771 MT. Barneveld, represented by its director R.A.H. Ozinga, hereinafter referred to as Freestays, is the distributor of the Freestays Hotel Voucher, the Freestays Hotel Annual Pass, the Freestays hotel discount voucher and the Freestays hotel discount voucher Annual Subscription. The Freestays Hotel Voucher and the Freestays Hotel Annual Pass entitle you to free nights in the hotels listed under the mention FREESTAYS HOTEL on Freestays.eu under the following conditions and the Freestays hotel discount voucher and the Freestays hotel discount voucher Annual subscription entitle you to a discount on the hotel stays under the following conditions or by the creation of such a discount through the use thereof.
2. Scope
The following terms and conditions apply to
all agreements between Freestays and their customers, including agreements relating to the use of the respective Freestays Hotel Voucher and the Freestays Hotel Annual Pass and the Freestays hotel discount voucher and the Freestays hotel discount voucher Annual subscription.
3. Conclusion of the contract with Freestays
The contract for the authorization of the use of hotel services from the Freestays online hotel catalogue between the customer and Freestays is concluded after the customer has ordered the ordered Freestays Hotel Voucher or Freestays Hotel Annual Pass with the conditions of participation or by sending his personal, individualized (unique code) Freestays Hotel Voucher or Freestays Hotel Annual Pass and the conditions of participation or the Freestays hotel discount voucher and the Freestays hotel discount voucher has ordered an annual subscription with the terms and conditions of participation or by sending his personal, individualized (unique code) discount voucher
4. Products
Freestays sells the Freestays Hotel Voucher and the Freestays Hotel Annual Pass.
Freestays sells the Freestays hotel discount voucher and the Freestays hotel discount voucher Annual subscription.
The Freestays Hotel Voucher entitles you to consecutive free nights for 2 people in a double room in one of the hotels mentioned in the hotel catalog under the label FREESTAYS HOTEL.
The Freestays Hotel Annual Pass entitles the customer to use the services of the hotels described in the hotel catalogue for a period of one year, in accordance with the period of validity indicated on the card.
Everything else is governed by the following conditions.
5. Use of Hotel Services/Bookings
A booking for the use of the services of the Freestays Hotel Voucher or the Freestays Hotel Annual Pass must be made by the user directly on Freestays.eu mentioned in the hotel catalogue. An accommodation agreement is concluded between the user and the hotel. For both telephone and written bookings, the user is obliged to book the chosen hotel including the code in force. If the user does not enter this code, he is not entitled to a room/night at the prices and conditions agreed with Freestays. All bookings are subject to the number of rooms available to the hotel or the number of rooms the hotel has reserved for Freestays customers (conditional). Upon arrival, the user must present the Freestays Hotel Voucher, Freestays Hotel Annual Pass, Freestays hotel discount voucher or the Freestays hotel discount voucher Annual subscription .
6. Minimum consumption/payments to the hotel
The user of the Freestays Hotel Voucher or the Freestays Hotel Annual Card is required to pay the hotel the minimum consumption price for breakfast and dinner per person per day, as agreed by the hotel in the booking confirmation. The minimum consumption includes breakfast and dinner. (Half Board/Full Board)
Some hotels also have the All Inclusive or Ultra All Inclusive option.
The exact size depends on the information about the respective hotel in the hotel catalogue. The user is also obliged to pay the corresponding minimum consumption price in the event of partial or non-use of breakfast and/or dinner. Expenses for drinks, facilities, additional hotel services, tourist tax, etc., are not included in the minimum consumption price for breakfast and dinner, to be paid by the user at the hotel, unless expressly stated otherwise in the hotel catalogue or in the hotel's booking confirmation. The stated consumer price is calculated per person and day. The hotel bill for the reserve price will be settled at the time of booking.
Any additional services used must be paid directly to the hotel on arrival, taking into account that some hotels may require a deposit upon arrival.
7. Cancellation or non-use of hotel services
If the user has booked with a contractual hotel, he must comply with the booking. Please note that in the event that the user cancels the booking or does not use it for the entire period, the hotel may charge up to 100% (80% in Germany) of the agreed price for the number of days booked.
8. Liability of Freestays/Hotel Data
The information on prices, conditions, hotel descriptions, etc. in the hotel catalogues is based on the information provided by the partner hotels. Freestays is not liable for the content and correctness of the information, nor for printing errors, interim changes in the offers of the hotels and the conditions under which the hotels offer their rooms. This applies in particular to any price increases affecting minimum consumption. The user is therefore advised to inform himself about the currently applicable prices and conditions when booking. When selling the Hotel Year Card or the Freestays Hotel Voucher, Freestays guarantees bookings at the hotels mentioned in the hotel catalogue. Availability depends on the hotel's quotas, which must be requested by the customer at the time of booking.
Freestays shall not be liable for defective, non-performed or untimely services provided by the hotel, in particular as a result of the accommodation contract concluded directly between the user and the hotel. Any warranty rights of any kind (discount, compensation, etc.) can only be made by the user vis-à-vis the hotel. In addition, Freestays is liable, if no bodily injury has occurred, up to the amount paid by the customer for the purchase of the Hotel Annual Card or the Freestays Hotel Voucher if the damage by the customer is not caused intentionally or by gross negligence on the part of Freestays. Freestays accepts no liability for loss of the Freestays Hotel Annual Pass, the Freestays Hotel Voucher, Freestays hotel discount voucherand/or the Freestays hotel discount voucher Annual Subscription.
9. Data
The customer's data required for the processing of the contract will be stored and may be passed on to the cooperation partners as part of the processing.
All personal data will be treated confidentially. The user agrees that his/her personal data will be stored and processed in Freestays' electronic data processing system.
10. Special information / Right of withdrawal
Provider
The provider of the Freestays Hotel Annual Pass, the Freestays Hotel Voucher, the Freestays hotel discount voucher and the Freestays hotel discount voucher Annual subscription is TravelAR Groep BV, Veemweg 29-31, NL 3771 MT. Barneveld, represented by director R.A.H. Ozinga.
Subject of the contract
The object of the contract is a purchase contract for the Hotel Annual Pass, the Freestays Hotel Voucher, the Freestays hotel discount voucher or the Freestays hotel discount voucher Annual Subscription with the right to use the services of the partner hotels mentioned in the hotel catalogue, taking into account a consumption in the corresponding hotels or under a room booked at a discount.
Formation of the contract
The contract between Freestays and the customer is formed when Freestays accepts the customer's request (order) by sending him the ordered products.
Participation fee
The participation fee depends on the respective offer on which the customer places his order.
Right of return/cancellation
The customer has the right to cancel her order of the Freestays Hotel Voucher, the Freestays Hotel Annual Card, the Freestays hotel discount voucher and/or the Freestays hotel discount voucher Annual Subscription within one month after receipt of the ordered products without giving reasons in writing at the above address and/or to return the products sent. The timely dispatch of the withdrawal or the return of the products is sufficient to meet the deadline. There is no right to a refund or cancellation if the customer has used hotel services from the hotel catalog before the end of the month.
B. Special Terms and Conditions Freestays Hotel Voucher
1. Validity/Renewal/Use
The Freestays Hotel Voucher and the Freestays hotel discount voucher can only be used once and cannot be exchanged for cash. The Hotel Annual Pass and the Freestays Hotel Discount Voucher Annual Subscription remain valid until the date stated on the Annual Pass. The holder has the right to extend unredeemed Hotel Annual Pass for one year upon presentation to Freestays for a processing fee of EUR 9.95 per card.
C. Special conditions Freestays Hotel Voucher
1. Membership/Contract Duration
The membership period of the Freestays Annual Pass and the Freestays hotel discount voucher Annual Subscription are valid for one year from the chosen start date (validity period) and will be extended for another year if it is not terminated (see below, point 3).
2. Freestays Hotel Voucher / Forms / Transferability / Obligations
Along with the Freestays Hotel Voucher, the holder will receive a code to redeem at Freestays.eu during the booking of a room. For any reservation of a stay in one of the partner hotels according to the hotel catalogue on Freestays.eu, the reservation form must be completed. A prerequisite for a successful booking is availability within the scope of the quota within the respective partner hotel. Reservation forms can be entered online at Freestays.eu
With the Freestays Hotel Annual Pass and the Freestays Hotel Discount Voucher Annual Subscription , the holder has the opportunity to make use of overnight stays in the chosen hotel for an unlimited number of people, provided that sufficient quotas are available in the chosen hotel after consultation with the hotel in question. The Freestays Hotel Annual Pass and the Freestays Hotel Discount Voucher Annual Pass are transferable within the holder's family, provided that the surname is identical, whereby the identity of the respective user with the name on the card must be proven to the hotel by presenting the identity card.
The unique Freestays code on the Freestays Hotel Voucher and the Freestays Hotel Annual Pass give a 100% discount on the room rate, excluding the costs mentioned in point 6 and will be processed directly in the price of the booking during booking with this code.
The unique Freestays code on the Freestays hotel discount voucher and the Freestays hotel discount voucher Annual subscription give a discount on the room price, excluded are the costs mentioned in point 6 and will be processed directly in the price of the booking during the booking with this code.
In the event of loss or theft of the Freestays voucher, the Freestays Annual Pass, and/or the Freestays hotel discount voucher Annual subscription, the holder must notify Freestays immediately; this can be done in writing by e-mail to [email protected].
Upon request, the cardholder will receive a replacement free of charge.
All products remain the property of Freestays. Freestays reserves the right to terminate the contractual relationship without notice for just cause. After the end of the contractual relationship, the Voucher or Annual Card may no longer be used; the holder must return it to Freestays without delay.
The right to keep the card is excluded. Freestays is entitled to inform the cooperation partners on blacklists which card numbers are considered to be missing. This also applies to the number of a card that has become invalid due to justified cancellation by Freestays. Freestays is only liable for damage caused by a card number that is not on the block list in case of intent or gross negligence, provided that there is no physical damage.
3. Membership renewal/cancellation of Freestays
The membership period (validity period) for the Freestays Hotel Annual Pass and the Freestays hotel discount voucher Annual Subscription will not be automatically renewed if the membership is not renewed in writing to Freestays at least 6 weeks before the end of the validity period stated on the card.
Final provisions
The place of jurisdiction for all disputes arising from the relevant contractual relationships between the customer and Freestays is, to the extent permitted by law, Amersfoort. Dutch law applies. Should individual provisions of these terms and conditions be ineffective or should there be a gap requiring regulation, the terms and conditions shall remain in effect. Freestays is entitled to change the general terms and conditions in a reasonable manner. Changes and additions will be communicated in writing. They shall be deemed to have been approved if no written objection is raised within one month.
